Customer Information: California Proposition 65 and BPS (Bisphenol S)

What is Proposition 65? Proposition 65 ("Prop 65") requires businesses to provide warnings to Californians about significant exposures to chemicals that cause cancer, birth defects or other reproductive harm. The OEHHA publishes and updates a list of chemicals including approximately 900 chemicals since it was first published in 1987. Proposition 65 became law in California in November 1986; the official name of Proposition 65 is the Safe Drinking Water and Toxic Enforcement Act of 1986.

Why was BPS added to the Proposition 65 list? BPS (Bisphenol S) is a color developer that helps create the image in thermal paper. BPS was added to the Proposition 65 list because of concerns about its potential to cause reproductive harm. Learn more about BPS and Prop 65 on the ОЕННА ВPS Fact Sheet. The warning obligation in California for significant exposure to BPS will take effect on December 29, 2024. Some thermal paper grades are produced with the use of BPS (Bisphenol S) and require a Prop 65 warning for BPS exposure when sold into California.

Note that not just the entities introducing the final product must be aware of Prop 65 compliance, but the entire supply chain can be implicated. We strongly suggest that all customers take the steps necessary to understand any additional compliance on your part that may be required with this legislation, i.e. the need to warn the Californian consumer at the point of purchase.
